Terms & Conditions

  1. These Terms and Conditions (“Terms”) govern your access to and use of the Americans for Decency in Government, Inc. website and related online services (the “Service”), operated by Americans for Decency in Government, Inc. (“ADG,” “we,” “us,” or “our”), a North Carolina nonprofit social welfare organization recognized under Section 501(c)(4) of the Internal Revenue Code. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

  2. Use of the Website - You agree to use the Service solely for lawful purposes consistent with our mission to promote honesty, integrity, and ethical leadership in government. You may not use the Service in any way that violates applicable laws or regulations, interferes with the operation or security of the Service, or transmits malicious or deceptive content. We reserve the right to restrict or terminate access in cases of misuse.

  3. Contributions, Purchases, and Payments - If you make a contribution, purchase merchandise, or register for an event through the Service, you may be asked to provide payment and personal information. By submitting that information, you represent that it is accurate, complete, and that you are authorized to use the chosen payment method. All payments are processed by trusted third-party vendors; ADG does not retain full payment card details. We may decline or cancel any transaction suspected of error, fraud, or violation of these Terms. Contributions to ADG are not tax-deductible for federal income tax purposes.

  4. Accuracy and Availability - While we aim to provide accurate, timely information, the Service may occasionally include errors, omissions, or outdated material. ADG reserves the right to correct or update content at any time without prior notice.

  5. Campaigns, Petitions, and Promotions - Any petitions, campaigns, or promotions hosted by ADG may be subject to additional terms specific to those initiatives. If there is a conflict, the campaign-specific terms will take precedence.

  6. Intellectual Property - All content on the Service—including text, graphics, logos, videos, photographs, and designs—is owned by or licensed to ADG and protected under U.S. and international intellectual property law. You may view and print materials for personal, informational, noncommercial use only. Reproduction or modification of our content for commercial or political fundraising purposes without prior written consent is prohibited.

  7. Third-Party Links - The Service may contain links to websites operated by third parties. These links are provided for convenience only. We are not responsible for and do not endorse the content, privacy practices, or policies of any third-party site. Your use of such sites is at your own risk.

  8. Termination - We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or misuse the Service. Any provisions intended to survive termination will remain in effect.

  9. Indemnification - You agree to indemnify and hold harmless ADG, its officers, directors, staff, volunteers, and agents from any claims, damages, or losses (including reasonable attorney’s fees) resulting from your use of the Service, violation of these Terms, or submission of content through the Service.

  10. Limitation of Liability - To the fullest extent permitted by law, ADG shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Service. Our total liability to you for any claim shall not exceed the greater of (a) the amount you paid to ADG in the preceding twelve (12) months, or (b) one hundred U.S. dollars ($100).

  11. Disclaimer of Warranties - The Service is provided “as is” and “as available.” ADG makes no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free access, nor that the Service will be free from harmful components.

  12. No Guaranteed Results - Participation in ADG programs, petitions, or campaigns does not guarantee specific outcomes or policy results. Results depend on factors beyond our control such as legislative or administrative actions.

  13. Force Majeure - We are not responsible for any failure or delay caused by circumstances beyond our reasonable control, including acts of nature, war, government restrictions, system failures, or labor disputes.

  14. Governing Law and Jurisdiction - These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. All disputes shall be brought in the state or federal courts located in Wake County, North Carolina.

  15. Privacy - Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

  16. Children’s Privacy - This Service is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that information was provided by a child, it will be deleted promptly.

  17. User Submissions and Testimonials - If you submit comments, testimonials, photos, or other materials to ADG, you grant ADG a nonexclusive, royalty-free right to use, reproduce, and display such materials in connection with our mission, public communications, and promotional activities. You may request removal of your content by contacting us.

  18. Interactive or Community Features - If the Service offers comments, discussion areas, or similar features, please note that any content you share may be visible to others. Exercise judgment before disclosing personal information.

  19. International Use - The Service is operated from the United States. By using it, you consent to the transfer and processing of information within the United States and jurisdictions where our vendors operate.

  20. Changes to These Terms - We may update these Terms periodically. The latest version will be posted here with an updated “Effective Date.” Continued use of the Service after updates constitutes acceptance of any revised Terms.

  21. Entire Agreement - These Terms constitute the entire agreement between you and ADG regarding the Service and supersede all prior understandings or agreements. If any provision is found invalid, the remaining provisions will continue in effect.
